1. WHO WE ARE
EBS-IT SERVICES CONSULTORIA EM INFORMÁTICA LTDA, a legal entity governed by private law, registered with the CNPJ under No. 10.531.357/0001-50, headquartered at Alameda Mamoré, nº 687, Conj. 401 - sala 04 - 131 - 4º andar, Alphaville Centro Industrial e Empresarial, Alphaville - Barueri, SP - CEP: 06.454-040, hereinafter referred to as "EBS-IT SERVICES", is an information technology company focused on meeting customer needs with innovation and assertiveness.
We at EBS-IT SERVICES respect the privacy of the personal data of all our customers, employees and partners. Our OBJECTIVE is to guarantee the integrity of personal data and safeguard your privacy.
The PURPOSE of this Privacy Policy is to demonstrate our commitment to the privacy and protection of personal data collected, establishing the rules on the collection, recording, storage, use, sharing and deletion of personal data collected, in accordance with Law No. 13,709/2018, the General Personal Data Protection Law.

1.1 GENERAL CONCEPTS
To begin with, it is important that you understand some of the concepts introduced by the LGPD:

SENSITIVE PERSONAL DATA: personal data on racial or ethnic origin, religious conviction, political opinion, membership of a trade union or religious, philosophical or political organization, data relating to health or sex life, genetic or biometric data, when linked to a natural person.
DATA SUBJECT: natural person to whom the personal data being processed refers.
PROCESSING: any operation carried out with personal data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination or extraction.
PERSONAL DATA PROCESSOR (DPO): a person appointed by the controller and operator to act as a communication channel between the controller, the data subjects and the National Data Protection Authority (ANPD).
The main responsibilities of the person in charge of processing personal data include receiving complaints and communications from data subjects, providing the necessary clarifications, adopting measures of interest to data subjects and communicating with the ANPD.
2. WHO IS RESPONSIBLE FOR PROCESSING PERSONAL DATA?
EBS-IT SERVICES is considered to be the CONTROLLER of the personal data of its employees, as it has control over personal data processing activities, i.e. it determines the processing purposes to which personal data is subject.
EBS-IT SERVICES, as a service provider and in cases where it does not have control over the processing of personal data, will act as the "Operator" of the personal data of the clients of the aforementioned "Controller" company.

EBS-IT SERVICES, under the terms of the legislation, may COLLECT, RECEIVE, CLASSIFY, USE, ACCESS, TRANSMIT, STORE, ARCHIVE, DELETE, SHARE with third parties, always in strict compliance with the Law, your personal data and registration information, when necessary for the fulfillment of the agreements made between the parties and, also, in other cases based on legitimate purposes, such as support and promotion of EBS-IT SERVICES activities or for the provision of services that benefit others involved in the process.
6. ABOUT SHARING YOUR PERSONAL DATA
EBS-IT SERVICES shares infrastructure, systems and technology with partner companies to provide an innovative, relevant, consistent and secure experience across all EBS-IT SERVICES products and services. In addition, we process information about you at the partner companies for this purpose as permitted by applicable law and in accordance with this policy.
Please note that new online services made available by EBS-IT SERVICES will automatically be subject to the Privacy Policy in force at the time of their use.

7. STORAGE AND INTERNATIONAL TRANSFER OF DATA

EBS-IT SERVICES is based in Brazil, but may process personal data in other countries by contracting partner companies, which in turn will be subject to the obligations of this Privacy Policy.
In cases where EBS-IT SERVICES carries out any type of international transfer of personal data, as well as if such an event occurs on behalf of its partners and clients, all personal data processing activities are in accordance with personal data protection legislation, observing compliance with the principles and rights of the data subject legally provided for in the LGPD. This protection is achieved through security and confidentiality policies and mechanisms, as well as specific contractual clauses for international transfers.
8. YOUR RIGHTS AS A PERSONAL DATA SUBJECT
In compliance with the applicable regulations, when in force, regarding the processing of personal data, in particular the General Data Protection Law (Law No. 13,709/2018), EBS-IT SERVICES respects and guarantees you the possibility of submitting requests based on the rights provided for in article 18 of the LGPD, such as access, deletion, portability, etc.
9. STORAGE TIME AND DELETION OF PERSONAL DATA
Your personal data will be processed and stored for the time necessary to carry out the purposes listed above and will be deleted after a specified period of time or at the request of the data subject in the exercise of their rights, where applicable, with the exception of storage in order to comply with a legal or regulatory obligation on the part of EBS-IT SERVICES.
10. HOW DO WE TREAT YOUR INFORMATION SECURELY?
Access to personal information collected, stored or otherwise processed by EBS-IT SERVICES is restricted to professionals authorized to directly use such information and necessary for the provision of its services, with limited use for other tasks.
Any organization or individual contracted to provide support services is also required to comply with the Privacy Policy adopted by EBS-IT SERVICES.
EBS-IT SERVICES is committed to providing quality and secure services. Therefore, in all processes, all plausible technical measures of the current state of technology are adopted in order to guarantee the security of personal data and to prevent their alteration, loss, processing and unauthorized access, whether due to human action or to natural, physical or electronic actions.
11. UPDATING INFORMATION
EBS-IT SERVICES reserves the right to improve the functionalities of the Services and to implement new technologies and products. Accordingly, the Terms of Use may be amended at any time, except in the event of a legal prohibition, to include the modifications implemented. By continuing to use our Services after the Terms of Use have been amended, you agree to the changes made and in force at the time of access.
12. INTELLECTUAL PROPERTY
EBS-IT SERVICES assures you that the information (texts, images, sounds and/or applications) contained on its websites is in accordance with the legislation and regulations governing intellectual property rights (copyright and industrial) and belongs to EBS-IT SERVICES or to a third party that has legally assigned its right of use. Modifications, copies, reproductions or any other form of use for commercial purposes are not permitted without the prior express consent of EBS-IT SERVICES. You declare that you will respect all intellectual property rights contained in our Services, aware that the right to access the Service does not grant any authorization to use intellectual property rights contained in such Service.

14. GENERAL PROVISIONS
Any omissions or mere tolerations by the parties in demanding strict and full compliance with this Privacy Policy and/or any prerogatives arising from it or the law shall not constitute a novation or waiver, nor shall they affect the exercise of any rights provided for herein, which may be fully and completely exercised at any time. If a provision is found to be void, the remaining provisions of this Privacy Policy will remain in full force and a valid term will replace the void term, reflecting our intention as much as possible.
15. APPLICABLE LAW AND CONFLICT RESOLUTION
Any and all disputes arising from the terms set out in this Privacy Policy shall be resolved in accordance with Brazilian law, with the jurisdiction of the city of São Paulo, State of São Paulo, to the exclusion of any other, however privileged. It is also clear that the use of the Services and orders placed outside Brazilian territory, or those resulting from operations initiated abroad, may also be subject to the legislation and jurisdiction of the authorities of the countries where they are placed or initiated.
